WEEKLY RENTALS:
The renting of all the properties present on the internet website
www.renttuscany.com and in the 2007 catalogue, will be concluded by
RENTUSCANY by Emma Villas on behalf of the owners under their
authorization, in compliance with the prices publicized on the website and
in the catalogue observing the terms and conditions provided by the
private agreement stipulated with the owners themselves.
RENTAL PERIOD:
RENTTUSCANY by Emma Villas deals with weekly rentals that go from Saturday
to Saturday, for a maximum of 4 consecutive weeks for the same client, if
provided for by the owner. It is possible to change the arrival and
departure days only during the low season but in any case only with the
owner’s consent.
OPTIONING AND BOOKING THE PROPERTY/PROPERTIES:
When the option request (via e-mail / fax / telephone) has been received
and when the availability of the house/houses for the chosen period has
been verified, RENTTUSCANY by Emma Villas will reserve the house/houses
for the client by sending (via e-mail / fax) the option confirmation.
° Not more than two properties may be optioned at the same time.
° The options will last for 72 hours, during which time the clients will
inform RENTTUSCANY by Emma Villas of their decision. During the high
season the option period will be reduced to 24 hours. If reservation will
arrive within 40 days prior arrival request are binding.
° The clients will receive the booking form from RENTTUSCANY by Emma
Villas (via e-mail / fax) containing: the client’s personal details, the
amount and maturity of the various payments (ADVANCE PAYMENT – BALANCE –
DEPOSIT), conditions of payment, general booking conditions.
° In the absence of any communication on the part of the client, the
optioned house/houses will become free and available for other clients.
° If it should happen that a client has optioned a property and intends
booking later with respect to the established 72 hours deadline and if a
second client has in the meantime optioned the same house for the same
period, the first client must wait on the decision of the second.
° With the dispatch via fax of the above mentioned countersigned booking
form and with the remittance of payment according to the ways and means
set out below, the booking goes into effect.
° When said documents have been received RENTTUSCANY by Emma Villas will
send the relative invoice as confirmation of the booking.
TERMS OF PAYMENT
The booking form contains the amounts and due dates of the various
payments needed to make the booking, as follows:
° 30% as deposit to be paid on the act of booking plus the costs of
opening the file Euro 40.00;
° 70% as balance to be paid in the forty days preceding the beginning of
location.
Balance payment by Credit card will be accepted with a charge of credit
card fees in the measure of
2 % for VISA and 3 % for AMEX to be calculated on the balance amount.
For bookings made one year in advance in properties that sleeps more than
10 persons, deposit required will be of a 50 %. Balance of the remaining
50% owed in the 40 days prior arrival.
On receipt of the balance RENTTUSCANY by Emma Villas will send the clients,
via e-mail, the documents relative to the booking (Voucher, Directions,
Invoice).
BOOKINGS MADE LESS THAN 40 DAYS BEFORE THE BEGINNING OF STAY:
In this case the clients must make the payment of the total amount of the
rent in one single instalment on the act of booking. The way of payment
will be the same as in the normal booking procedure.
CANCELLATIONS:
The cancellation of a booking, even if substituted by another, will entail
the payment of the following penalties
° 30% of the total amount of the booking plus the costs of opening the
file in the case of cancellation of the booking communicated before the
40th day preceding the beginning of the stay;
° 60% of the total amount of the booking plus the costs of opening the
file in the case of cancellation of the booking communicated between the
39th and the 30th day preceding the beginning of the stay;
° 80% of the total amount of the booking plus the costs of opening the
file in the case of cancellation communicated between the 29th and the
15th day preceding the beginning of stay;
° 100% of the total amount of the reservation plus the costs of opening of
file communicated in the 14 days preceding the beginning of stay.
To the renunciative client will be given the possibility of booking
another holiday taking advantage of a 10% discount on the catalogue prices.
COMMUNICATION OF RECESSION:
Communication of recession or cancellation of booking must arrive on a
working day (from Monday to Friday from 9 am to 7 pm) prior to arrival and
must be communicated by fax or e-mail and will not include the day of
arrival or the day of said communication.
SERVICES:
The property description present two different categories of services so
that clients may distinguish between the services included in the location
price and the extra services:
For example:
- SERVICES INCLUDED
- SERVICES NOT INCLUDED
- SERVICES ON REQUEST PAYABLE ON SITE TO THE OWNER (to be booked at least
40 days before the beginning of stay).
Heating and A/C costs are never included in the price (excluding some
exceptions - read carefully the detailed property description). Clients
will find heating and A/C costs mentioned in the property description
under the voice services not included. In some of the properties this cost
is calculated on the base of consumption while in others the owners have
established a fixed weekly cost. In both cases the heating cost and A/C,
as all the other costs (for example, telephone), will be paid on the spot
to the owner or his representative on departure. The use of heating and
A/C, as regards the temperature and period of use, is regulated by local
laws varying from region to region but, in general, the heating units can
be used from November to April while the A/C during the summer season.
Clients are bound to keep to these regulations.
TIME OF ARRIVAL AND DEPARTURE:
Normally the day of arrival and departure is Saturday unless another day
is indicated on the property card. The times scheduled for arrival are
between 04.00 and 07.00 pm.
We invite clients to let us know at least a week before the beginning of
stay at what time they will be arriving so that the owner or his/her
representative can be on site waiting for the clients in order to
facilitate entry to the property. Any change regarding date and time of
arrival must be communicated to RENTTUSCANY by Emma Villas as soon as
possible via e-mail / fax or telephone to the RENTTUSCANY by Emma Villas
customer service number. If arrival should be in the evening after 08.00
pm, it will be at the owner’s discretion whether to accept the check-in or
not. If the owner cannot accept a delay on the arrival day, the client
must pay the costs of an overnight stay in another structure, different
from that reserved with RENTTUSCANY by Emma Villas. RENTTUSCANY by Emma
Villas will however make every effort to help the arrival of the clients
at the reserved property confiding in the collaboration of the owners and
clients.
Departure from the property will be in the morning before 10.00 am, thus
allowing access at 09.00 am to the owner to inspect the state of the
property and to the cleaning crew to get the place ready for the afternoon
arrivals.
ARRIVAL AT THE HOUSE:
On arrival clients are requested to present the entry voucher and a
personal document (passport or identity card) to the owner or his/her
representative for registration as required by Italian law.
SECURITY DEPOSIT:
On arrival the client must pay the owner or the owner’s representative the
security deposit indicated in the property card either in cash, traveller’s
cheque or Euro cheque. This deposit will be returned to the client on
departure after the state of the property has been checked and after
deduction of eventual damages caused by the client and eventual
supplementary costs not included in the rent (for example telephone costs).
The owner has the right to refuse entrance to the client who has not paid
the security deposit. If a client departs earlier, or if he departs at a
time different to the time agreed upon, the owner or the owner’s
representative is authorized to return the security deposit by post (having
deducted consumption costs and eventual damages) only after having checked
the inventory of the property. In the case of controversy between client
and owner for eventual damages caused to the structure and contents
thereof during the stay and where there is need to repair the damage, with
consequent payment against invoice, the owner or the owner’s
representative is authorized to return the security deposit by post after
having deducted the sum of the invoice and attached a copy for the client.
RENTTUSCANY by Emma Villas declines any responsibility in the case of any
dispute regarding the deposit between client and owner.
NUMBER OF GUESTS AND THEIR IDENTIFICATION:
At the time of booking the clients are required to declare all their names
and the age of any children under 10 who will be staying in the property
and whose presence will be communicated to the authorities. Each property
description, both on the web and in the catalogue, indicates the maximum
number of people that the house is able to accommodate. This number (adults
– children) must not be exceeded in any way. RENTTUSCANY by Emma Villas
must be informed and must approve any substitution or increase in the
number of guests that will occur in the property during the stay, agreeing
with the owner who will be free to charge any extra costs.
If clients didn’t advise RENTTUSCANY by Emma Villas and owners about extra
guests presence, owner will be free to send away the exceeding persons
from the property.
ANIMALS:
Each property description indicates whether animals are permitted or if it
has to be asked to an RENTTUSCANY by Emma Villas operator. If clients are
allowed to do so, they will be required to pay an extra for cleaning which
will be paid on site to the owner. At the time of reservation
the client is required to communicate any pets he/she will be bringing,
indicating number and size. The owner can prohibit entry to the client who
brings an animal without having communicated such at the moment of booking.
HOUSE CLEANING:
House cleaning is included in the weekly price, unless indicated
differently in the property card published on the web and in the catalogue.
The pieces of furniture must be returned clean and in order in all parts
and accessories. If not, the client will give the owner or his/her
representative the monies necessary for repair. It is the client’s task to
deal with the garbage unless differently indicated. The owner can put
extra housecleaning, with times and days to be established, at the
clients’ disposal to be paid on site.
POOL AND PARK MAINTENANCE:
The swimming pools will be open in the periods indicated on the property
description (opening in low season will be regulated following the weather
conditions).
Any opening outside the period indicated will be agreed upon with the
owner and will entail payment of a supplement.
It is the owner’s job to deal with the maintenance of the pool and of the
park: it is for this reason that the staff charged with this task will be
able to enter the property every time it is deemed necessary. Days and
times will be indicated in the property description and in each property’s
information brochure.
RESPONSIBILITY:
All the properties present in the 2007 RENTTUSCANY by Emma Villas
catalogue and internet website have been inspected and photographed by
RENTTUSCANY by Emma Villas. The descriptions published by our company
correspond to the state of the property at the time of our visit and
acquisition and have been compiled in good faith. If at the time of
arrival or during the week the clients should note serious inaccuracies in
the description of the property, or should any problems arise that he/she
is not able to resolve or minimize, we request the clients to contact
RENTTUSCANY by Emma Villas immediately (Customer Service tel. 0039 0578
21192. Office hours: 09.00 to 13.00, 15.30 to 19.30), with confirmation in
writing within 24 hours via fax (0039 0578 223833) or via e-mail (customerservice@renttuscany.com).
RENTTUSCANY by Emma Villas will make every effort to resolve the problem
in order to guarantee the guests a pleasant stay at the reserved property.
Without communication in writing or without the authorization of
RENTTUSCANY by Emma Villas, clients who leave the holiday home before the
decided date will not have any right to reimbursement of the rental price.
If a client presents a protest to RENTTUSCANY by Emma Villas after the
stay, he/she will not have any reimbursement of the paid price. If
RENTTUSCANY by Emma Villas is forced to cancel the clients booking for
reasons beyond their will or by reason of force majeure, they will find,
in agreement with the client, another house having the same requisites as
the property already booked. If the price of the new property is inferior,
RENTTUSCANY by Emma Villas will reimburse the difference to the client.
Whereas, if the price of the new property is 10% superior than the price
paid by the client, the client, on accepting the new property, will pay
the difference. If the parties are not able to reach an agreement about
the substitution of the property, RENTTUSCANY by Emma Villas, on receipt
of a written cancellation on the part of the client, will reimburse the
amount of money paid. We would remind clients that the properties chosen
by RENTTUSCANY by Emma Villas are private houses with SELF-CATERING and
not hotel or farm holiday structures and as such they are not classified
in internationally known categories, they are not provided with the
services and characteristics of receptive structures and have been
restructured and furnished according to the tastes of the owners in
keeping with traditional Italian architecture. What RENTTUSCANY by Emma
Villas offers their clients is a life style, in other words the
possibility of living and getting to know the habits and customs of the
local population by spending a holiday in houses that represent Italian
tradition and local history. The criteria adopted by RENTTUSCANY by Emma
Villas in the choice and selection of the structure are based on the
identification of characteristics and accessories capable of guaranteeing
a high level of comfort responding positively to the needs of an
international public.
The Owner and RENTTUSCANY by Emma Villas are not responsible for any value
or personal objects left unprotected in the property by the guests.
RULES OF BEHAVIOUR:
Clients are kindly requested to adhere to the rules of behaviour in force
in our country, regarding good manners and respect towards the owner and
the structure in which they are staying. It is absolutely forbidden to
move furniture around, to take furniture and ornaments outside the
property and to use them in a different way from their intended use.
In the case in which a client does not respect the rules of good behaviour
and this results in damage to the structure and the contents thereof or to
the outdoor equipment pertaining to the garden or the pool, the owner has
the unchallengeable right to consider annulled the rental contract by
means of verbal communication to the client and by means of written
communication, in copy, to the agency and to ask the client to leave the
property immediately with the right to resort to the police if necessary.
HANDLING OF PERSONAL DATA:
Personal data and all other elements gathered by our Agency during the
course of our work, will be subject to secrecy and will be treated in
respect of confidentiality and personal rights through our systematic
application of correct protection measures and guarantees drawn up for the
handling of paper and electronic data in the measure of the specific data
(simple personal data or sensitive or judiciary data). In conformity with
the law 196/03 the Client is informed that his/her personal data will be
handled only for the uses determined by the contractual relationship for
such aims (including accounting and administrative aims). The Client is
informed that this data could be used for commercial and promotional
activities regarding the services provided by our Agency and for which use
the Client’s consent is required. The Client’s want of consent will not
permit our Agency to use this personal data for any commercial activity.
